ELLY™ – The Elector List™

DATA HANDLING AND PRIVACY POLICY

EagleAI™ NETwork, LLC  •  Effective 9/9/26•  Version 3.1

  1. Purpose and Scope

This Policy describes how EagleAI NETwork, LLC ("EagleAI") handles data in connection with ELLY – The Elector List™ ("ELLY" or “the platform”). It is incorporated by reference into the ELLY Terms and Conditions and is available to Users and information technology and security staff of any election office upon request.

"User" means the individual natural person to whom EagleAI issues credentials, acting in that person's individual capacity. A User is not the person's employer, office, agency, or organization, and no employer, office, agency, or organization is a party to these Terms.

This Policy covers two distinct categories of data, which EagleAI keeps separate: (a) the public records ELLY compiles and displays and (b) information about the people who use ELLY (“Users”).

  1. System Boundaries

ELLY has no electronic connection to any state or county voter registration system — including the Georgia Registered Voter Information System (GARViS) — or to any election management system, electronic pollbook, ballot-marking device, or tabulation equipment. The platform receives no data from any such system other than voter registration lists lawfully obtained as public records and operates only on its own copy of that data. Neither ELLY nor its Users can read from, write to, alter, or delete any official record. ELLY does not consider an applicant's political party, political affiliation, viewpoint, race, color, religion, sex, national origin, or disability in granting, denying, or revoking access.

  1. Data Sources

ELLY compiles records and data that are lawfully available from public and commercial sources, including:

  • State voter registration lists
  • U.S. Postal Service National Change of Address (NCOA®) information for registrants
  • U.S. Postal Service Coding Accuracy Support System (CASS®) address information
  • U.S. Postal Service Proprietary Change of Address (PCOA) information
  • Commercial Mail Receiving Agency (CMRA) listings
  • County property tax assessor records
  • Published obituaries and death records

The platform does not create records in the above data sources. These data source records displayed throughout the platform originate with government and other public sources. Where an underlying record is inaccurate or incomplete, the error originates with that source; ELLY does not alter or correct, and has no authority to alter or correct, any official record.

Some records contain formatting artifacts — non-ASCII, special, or foreign characters, or irregular spacing — that originate with the source system.

  1. Collection and Use of User Data

To grant and maintain access, ELLY collects the following:

  • Account information: legal name, residential address, phone number, email address
  • Eligibility attestation and date: renewed at each sign-in
  • Contribution and audit records: for Users with Citizen, Election Worker, or Admin access, a record of each submission, its content, and the identity of the submitting User
  • Technical information: IP address, browser and device type, and session timestamps

ELLY records the following information about how the platform is used:

  • Sign-in IP address, with timestamp and browser information
  • User submitted content, including comments and attachments, associated with the authenticated account (anonymous submissions are not enabled by the platform)
  • Server activity logs containing IP addresses and server requests, rotated every 30 days

EagleAI uses collected information exclusively for the following purposes:

  • Verifying User identity and platform access eligibility
  • Maintaining and securing platform functionality and operations
  • Responding to technical and account support requests
  • Enforcing the ELLY Terms and Conditions and investigating potential misuse
  • Complying with applicable legal and regulatory obligations
  1. Disclosure to Others

EagleAI does not sell User information, nor is User data utilized for political purposes, targeted communications, or shared with any political party, campaign, committee, candidate, or advocacy organization.

EagleAI discloses information only as follows:

  • Legal process. EagleAI may disclose information in response to a subpoena, court order, or other lawful demand, or where required by law.
  • Security and misuse. EagleAI may disclose information as necessary to investigate or prevent a security incident, fraud, misuse, or other criminal activity.
  • Service providers. EagleAI may disclose information to vendors that provide hosting, email or text-message delivery, identity verification, and address-quality services, solely so that they may provide those services to EagleAI. Each is bound by contract to protect the information and is prohibited from using it for any other purpose.
  • Successor in interest. If EagleAI is merged, acquired, or dissolved, information may transfer to a successor, which will remain bound by this Policy or by a policy at least as protective. EagleAI will give Users notice before any such transfer takes effect.
  1. Security

EagleAI maintains administrative, technical, and physical safeguards designed to protect information against unauthorized access, disclosure, alteration, and destruction. No system is perfectly secure, and EagleAI does not warrant that ELLY is invulnerable to compromise.

Users are required to use unique credentials and are prohibited from sharing them.

  1. Retention and Deletion

EagleAI retains account information and identity-verification records forever; and activity logs for 30 days.

A User may request deletion of their account and associated account information by contacting EagleAI at https://theelectorlist.com/contact-us. EagleAI will honor the request except where retention is required by law or is necessary to resolve a dispute or investigate a security incident.

  1. Records Retention Obligations of Government Users

Nothing in this Policy or in the Terms and Conditions requires or authorizes any User to destroy, alter, conceal, or withhold a record the User is obligated to create, retain, or produce under applicable law, including the Georgia Records Act, state public-records law, and federal retention requirements applicable to records relating to elections. Where a legal retention obligation conflicts with anything in this Policy, the legal obligation controls.

EagleAI's and ELLY's internal logs are records of EagleAI and are not maintained on behalf of any government office.

  1. Data Breach

If EagleAI becomes aware of a breach of security resulting in the unauthorized acquisition of personal information, EagleAI will notify affected Users, and any other person or authority entitled to notice, without unreasonable delay and consistent with applicable law, including O.C.G.A. § 10-1-912 and the breach-notification law of the affected User's state of residence. EagleAI will describe what occurred, what information was involved, and what steps have been or are to be taken.

  1. Cookies, Analytics

Session cookies are used to store User preferences and session data. There are no third-party cookies or analytics used on ELLY.

  1. Age and Geographic Scope

ELLY is not directed to, and EagleAI does not knowingly collect information from, anyone under 18. ELLY is intended for use in the United States.

  1. Changes to This Policy

EagleAI may update this Policy at any time. The current version and its effective date are maintained at https://theelectorlist.com. Prior versions will remain available for reference.
