ELLY™ – The Elector List™
TERMS AND CONDITIONS
EagleAI™ NETwork, LLC • Effective 9/9/26 • Version 3.1
- Purpose and Scope
This document establishes the binding Terms and Conditions governing access to and use of ELLY – The Elector List™ (“ELLY” or “the platform”), a data analytics and research platform owned and operated by EagleAI LLC ("EagleAI").
"User" means the individual natural person to whom EagleAI issues credentials, acting in that person's individual capacity. A User is not the person's employer, office, agency, or organization, and no employer, office, agency, or organization is a party to these Terms.
- What ELLY Is and What ELLY Is Not
ELLY aggregates publicly available records and displays possible discrepancies in a voter registration record for review by the person using it. The platform makes no determination of any person's eligibility to register or vote. ELLY does not recommend, request, or effect the removal of any registration from any voter registration list. The platform produces indicators, or flags, for human review — nothing more. A flag is not a determination that any registration is invalid. ELLY is not a fraud detection system, nor does it identify, investigate, or confirm instances of voter fraud. ELLY does not display or determine any person's citizenship, eligibility, or intent, and no User may represent that it does.
Information submitted by a User is stored as a separate, attributable annotation, is timestamped, is labeled as user-submitted, and never overwrites, replaces, or is displayed as a public record.
Any action taken in reliance on information displayed in ELLY is the sole responsibility of the person or office taking it, and must comply with the National Voter Registration Act, the Help America Vote Act, and all applicable state law.
- Nature of Service and Access Rights
ELLY is a hosted Software-as-a-Service (Saas) platform accessed exclusively through a web browser. EagleAI does not deliver, furnish, install, or transfer any software, database, copy, or property to any User. Users do not download or acquire possession of ELLY, nor do Users retain any part of the platform upon session termination, except for reports or data exports generated in the ordinary course of platform use as permitted under Section 6A. Any such report or export constitutes merely a static copy of information viewed by the User. It does not convey any ownership interest in ELLY or its underlying compiled database, and remains fully subject to Sections 9, 10, and 11.
EagleAI grants the credentialed User a limited, revocable, non-exclusive permission to access the hosted service during an authorized session. Nothing in these Terms conveys to any User any ownership interest, license, leasehold, loan, or property right in ELLY, its underlying software, or the compiled data displayed. Records displayed through ELLY are compiled from public sources available for direct public inspection.
EagleAI and its licensors retain all right, title, and interest in and to ELLY, including all associated intellectual property rights.
- Uniform Terms, Fee Waiver, and Government Neutrality
4.1 Uniform Terms and Fee Waiver
These Terms apply identically to all Users. EagleAI provides access to ELLY at no charge and does not charge, invoice, solicit, or accept payment or items of value from any User, county, election office, or unit of government. Access is granted strictly to natural persons in their individual capacity. No government body is a party to these Terms or incurs any financial or operational obligation arising from a User's access.
4.2 Government Neutrality and Prohibited In-Kind Contributions
EagleAI provides no User with priority support, nor does it furnish any government entity, employee, or election official with funds, equipment, hardware, software, staffing, personnel, facilities, or services beyond standard, publicly available research tool access under published terms.
4.3 Statutory Position and Individual Legal Responsibility
EagleAI maintains that granting access to ELLY does not constitute the solicitation, provision, or acceptance of a contribution, donation, service, or thing of value to or by any governmental entity or official within the meaning of O.C.G.A. § 21-2-18(c) or comparable state provisions. EagleAI assigns no monetary value to platform access. This position reflects EagleAI’s policy interpretation and does not constitute formal legal advice; government users are encouraged to consult their own legal counsel prior to requesting access.
- Voluntary Private Donations
Voluntary donations, if any, are accepted only from persons and entities, and confer no right, priority, or capability of any kind.
- Access Tiers and Conditions
6A. Levels of Access
Access to ELLY is granted solely on the uniform, published conditions stated below and applied identically to every User:
- Public Access: Permits Users to view records compiled from public sources. Confers no ability to enter, alter, annotate, or submit information.
- Citizen Access: Permits Users to view records compiled from public sources, submit annotations and supporting documentation, as well as export records.
- Election Worker Access: Available to employees and appointed members of an election office upon official verification. Permits Users to view records compiled from public sources, submit annotations and supporting documentation, as well as export records.
- Admin Access: Restricted exclusively to select EagleAI personnel and contractors, who are bound by written confidentiality obligations and granted minimal necessary privileges.
No level of access permits any User to alter or modify a source record.
6B. Eligibility and Attestation
To obtain access, a user must be at least eighteen (18) years of age; must provide and verify their legal name, residential address, email address, and phone number; and must accept these Terms and the Data Handling and Privacy Policy. Additionally, users must agree to complete the onboarding orientation (“Getting Started” videos) prior to initial use.
The User must further attest that User:
- Has not been convicted of, or found liable in a civil action arising from, any election-related offense or violation of election law, including voter fraud, voter intimidation, or unlawful interference with an election
- Has not been convicted of identity theft, or of fraud involving the misappropriation of another person's personal information
- Has not been convicted of unauthorized access to a computer or computer network, including any offense under the computer-crime statute of any state (including the Georgia Computer Systems Protection Act, O.C.G.A. § 16-9-90 et seq.) or the federal Computer Fraud and Abuse Act
- Has not been convicted of perjury, falsification of records, or making a false statement to a government agency
- Is not subject to any court order restricting the applicant's participation in election-related activity;
- Has not previously had access to ELLY revoked for cause
- Is not acting for, at the direction of, or as a conduit for any person who would not be able to make each of these attestations
The User affirms that the foregoing is true and correct. The User must promptly notify EagleAI if any statement ceases to be true. A false attestation is cause for immediate revocation of access under Section 13 of the Terms and Conditions.
6C. Attribution and Audit
Every submission is permanently associated with the verified identity of the submitting User and with a timestamp. EagleAI maintains a record of all submissions. No anonymous or pseudonymous accounts are permitted, and no User may submit information into ELLY on behalf of another person.
6D. Nondiscrimination
EagleAI does not consider, and shall not consider, an applicant's political party, political affiliation, viewpoint, race, color, religion, sex, national origin, disability, or age (except the minimum age stated in Section 6B) in granting, denying, or revoking access.
6E. Integrity Controls
EagleAI may apply limits to exports. EagleAI may suspend or revoke access where a User makes inaccurate submissions, fails to provide documentation supporting a submission, or makes improper use of ELLY or of data obtained through ELLY, in accordance with Section 13.
- Acceptance
By requesting access to or using ELLY, the User acknowledges having read, understood, and agreed to these Terms. A User who does not agree must not access ELLY. A User accepts these Terms in the User's individual capacity. Nothing in these Terms constitutes a contract for services with, or imposes any payment obligation upon, any county, election office, or unit of government.
EagleAI retains, for each User, the version of these Terms and of the Data Handling and Privacy Policy accepted, and the date and time of acceptance.
- Independent Verification Required Before Acting on a Registration
Information displayed in ELLY may be a possible discrepancy requiring verification. It is not evidence of ineligibility, wrongdoing, fraud, or improper intent by any person, and it must not be characterized as such.
Before submitting a challenge, initiating list-maintenance procedures, or taking any official or public action in reliance on information displayed in ELLY, User shall independently verify that information against authoritative sources.
User shall not use ELLY as the sole basis for any voter list maintenance activity. User shall use ELLY only to gather supporting evidence for review and to identify potential data outliers requiring further investigation and independent confirmation before any action is taken.
An election official shall in all cases follow the notice, waiting-period, and other procedures required by the National Voter Registration Act and applicable state law before any voter registration status is changed.
EagleAI makes no representation that any record displayed in ELLY is accurate, current, or complete. Underlying records originate with government and public sources and may contain errors that EagleAI neither creates, changes, nor corrects.
- Prohibited Conduct and Data Disclosure Rules
9.1 Prohibited Conduct
User shall not:
- Enter, submit, or transmit information the User has not personally verified, or knows or reasonably should know to be false
- Use ELLY or data obtained through ELLY to harass, intimidate, threaten, stalk, or discriminate against any person
- Violate their state regulations regarding use of voter data
- Use ELLY or data obtained through ELLY for commercial solicitation, advertising, marketing, employment screening, tenant screening, credit or insurance eligibility decisions under 15 U.S.C. § 1681b
- Use ELLY to identify voters by political party or inferred political affiliation; ELLY does not access or display party affiliation, and User shall not attempt to derive it
- Share, sell, rent, lease, sublicense, or transfer credentials or access, or permit access by any person who has not accepted these Terms
- Decompile, reverse-engineer, disassemble, or attempt to derive source code; modify or create derivative works; scrape, bulk-extract, or reproduce the compiled database; or circumvent any technical or access control
- Use automated means to access ELLY except as EagleAI expressly authorizes in writing
- Use ELLY for any purpose prohibited by federal, state, or local law
These restrictions do not prohibit disclosure where specifically authorized or required by law, including:
- Formal administrative challenges or complaints filed under O.C.G.A. § 21-2-229, § 21-2-230, or comparable state statutes
- Responses to lawful public-records requests, subpoenas, or court orders
- Official duties performed by public officials, legislative testimony, or administrative board submissions
Nothing in these Terms requires any User to withhold information the User is statutorily required to disclose.
- Data Security
User shall maintain reasonable security on any device used to access ELLY, including current operating-system and antivirus updates and controls against unauthorized access. User shall use unique credentials and shall not share them. User shall safeguard any report, export, or record containing personal information obtained through ELLY, and shall promptly notify EagleAI of any known or suspected compromise of credentials or data.
- Records Retention
When a report or export containing personal information is no longer needed and is not subject to any retention obligation, User should dispose of it securely. Nothing in these Terms requires or authorizes any User to destroy, alter, conceal, or withhold any record that the User is required to create, retain, or produce under applicable law — including the Georgia Records Act or a comparable provision of another state, state public-records law, and the federal retention requirements applicable to records relating to elections. Where these Terms and a legal retention obligation conflict, the legal obligation controls.
- Data Handling
EagleAI maintains a published “Data Handling and Privacy Policy” describing what information ELLY records about User activity and the purposes for which it is used. That policy is available here.
- Suspension and Revocation
EagleAI may suspend or revoke a User's access for any reason or no reason. Reasons include, but are not limited to:
- Breach of these Terms, including any conduct prohibited by Section 9
- A false attestation under Section 6B
- Failure to maintain eligibility under Section 6B
- Submitting information that proves inaccurate, or failing to provide documentation supporting a submission
- Entry of information the User knows, or should have known, to be false, or has not personally verified
- Failure to review the training materials outlined in Section 6B
- Sharing or transfer of credentials
- Use of ELLY or its data for an unlawful purpose
- A security compromise of the User's credentials or device that presents a continuing risk
EagleAI shall apply this Section uniformly.
Upon revocation, the User's permission to access ELLY ends. Sections 8 through 11 and 14 through 19 survive.

While we strive for accuracy, we make no representations or warranties, express or implied, regarding the completeness, reliability, timeliness, accuracy, or suitability of any data displayed. All content is offered "AS IS," and nothing herein should be interpreted as legal, financial, or official guidance, or as an official record or determination of any government office.
We are always in the process of loading and processing data, so information on the site is subject to change at any time. If you believe information displayed is inaccurate, please contact EagleAI via our website contact page.
By accepting these Terms, User acknowledges having read and agreed to them, assumes full responsibility for any actions taken based on the information provided, and agrees that EagleAI NETwork, LLC and its officers, directors, employees, consultants, and agents shall not be liable for any losses or damages arising from the use of ELLY, to the maximum extent permitted by law and subject to Sections 16 and 17.
- Changes to this Policy
EagleAI may amend these Terms. Amendments take effect on the date published, and EagleAI shall give Users reasonable advance notice of material changes. A User manifests acceptance of an amendment by continuing to use ELLY after its effective date; the attestation and acceptance recorded at each sign-in evidence the version in force at that time. A User who does not accept an amendment may discontinue use.
- Disclaimer of Warranties
ELLY IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, CURRENCY, SECURITY, OR NON-INFRINGEMENT. EAGLEAI DOES NOT WARRANT THAT ELLY WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY RECORD DISPLAYED IS ACCURATE OR CURRENT.
- Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, EAGLEAI SHALL NOT BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, INCIDENTAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING LOST PROFITS, LOSS OF DATA, OR BUSINESS INTERRUPTION, EVEN IF ADVISED OF THE POSSIBILITY. BECAUSE ELLY IS PROVIDED AT NO CHARGE, EAGLEAI'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO ELLY OR THESE TERMS SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100.00).
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IN THOSE JURISDICTIONS, EAGLEAI'S LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.
- Indemnification
To the fullest extent permitted by applicable law, User shall indemnify and hold harmless EagleAI and its officers, directors, employees, consultants, and agents from any claim, liability, loss, or expense (including reasonable attorneys' fees) arising out of the User's breach of these Terms, the User's unlawful use of ELLY or its data, or the User's disclosure of data in violation of Section 9.
EagleAI will give the User prompt written notice of any claim for which it seeks indemnification. EagleAI may control its own defense with counsel of its choosing at the User's expense, and no settlement binds EagleAI without its written consent.
This Section does not apply to any User acting in an official capacity on behalf of a governmental entity, to the extent that indemnification by such User or entity is prohibited or restricted by applicable law.
- General
- Governing law. These Terms are governed by the law of the State of Georgia, without regard to its conflict-of-laws rules.
- Any dispute shall be brought exclusively in the state or federal courts located in Georgia, except that nothing in these Terms limits the sovereign immunity or venue rights of any governmental entity.
- Limitations period. Any claim arising out of or relating to ELLY or these Terms must be brought within one (1) year after the claim accrues, to the extent such a limitation is enforceable.
- If any provision is held invalid or unenforceable, the remainder of these Terms remains in effect, and the invalid provision shall be enforced to the maximum extent permitted by law.
- Sections 8 through 11 and 14 through 19 survive termination of access.
- Status of EagleAI. EagleAI NETwork, LLC is a private company. It is not a public agency, holds no contract with any government office, receives no public funds for ELLY, and performs no service or function on behalf of any agency. Nothing in these Terms creates such a relationship or makes any User an agent of EagleAI. EagleAI responds to subpoenas, court orders, and other lawful process as described in the Data Handling and Privacy Policy.
- A User may not assign these Terms or transfer access. EagleAI may assign these Terms to a successor in connection with a merger, acquisition, or sale of assets, on notice to Users.
- EagleAI may give notice electronically to the address associated with the User's account. Notice to EagleAI must be sent to info (at) theelectorlist.com.
- Entire agreement. These Terms, together with the Data Handling and Privacy Policy referenced in Section 12, are the entire agreement between EagleAI and the User regarding access to ELLY.
- No waiver. EagleAI's failure to enforce a provision is not a waiver of it.
- Export control. User shall comply with applicable United States export-control and sanctions laws.
By requesting or using access to ELLY, User acknowledges having read, understood, and agreed to these Terms and Conditions of Use.
